Conducting Fair and Proper Domestic Enquiry
The Human Resource is the crucial component of an organization, which exploits other organization resources to achieve the organizational objectives. To attain the organizational objectives and optimum productivity from the employees, organizations provide the system of Reward and punishment. It is essential that every organization, regardless of its being a government or semi-government or private, should have a well-established reward and punishment system to guarantee to attain the organizational objectives through the people’s work. Moreover, performance, productivity and reputation of an organisation requires the employees of the establishment to be at their best behaviour and abide by prescribed ethical and behavioural standards. To this end, the organisation may take disciplinary action against acts of employees which fall short of standards prescribed by law or the organisational policies and rules. While employer reserves a right to take appropriate action against the employees who violate company policies, in order to initiate a disciplinary action, the organisation/department is required to conduct a fair domestic enquiry.
Programme Objective
This programme would assist participants, to
- Understand the basic procedure for the domestic enquiries
- Get the insights of fundamental reasons for the disciplinary enquiry from being challenged before a judicial forum
- Know the role of investigating officer (IO)
- Learn how to prepare a charge sheet
- Learn the documentation and evaluation of evidence during the conduct of enquiry
- Know how to write an IO’s report
Content Outline
Day One: Role of IO, procedure for the conduct of enquiry, documentation and evaluation of evidence
Day Two: Constitutional Provisions and Principles of Natural Justice, Special Circumstances (De novo inquiry,
Parallel Proceedings, Change of IO/PO,etc.), Conduct of Inquiry in cases of complaints under POSH Act
Day Three: Understanding charge sheet, Different Forms/ Briefs/ Reports used in Departmental Inquiry, Report writing,
Day Four: Mock enquiry and Project Work

Who Should Attend?
This programme is recommended for executives, managers, HR and IR professionals and vigilance officers who are actively involved in initiating and conducting domestic enquiries.
This is a practical short-term program which focuses on developing the key knowledge and skill required by professionals when negotiating and drafting commercial contracts that involve parties, laws or businesses. It is important that professionals have the sufficient knowledge and skills to achieve their desired outcome from a commercial contract negotiation.

Participants should be nominated by their organizations. The enclosed nomination form should be completed and returned with all the
details. The fee of the program is Rs. 40,000/- (Rupees Forty Thousand only) per participant which includes a professional fee and all
charges for lodging and boarding and supply of course materials. GST as applicable will be charged extra in addition to the programme
fee. Payment should be made by Cheque/NEFT/RTGS.
